ACCEPTABLE USE POLICY FOR

1. Content Standards
   1. These content standards (“Content Standards”) apply to all Content and the use of the Interactive Services. Each User agrees that his/her Content shall:
      1. comply with the law applicable in any country from which it is posted and to which our site is targeted;
      2. not contain illegal content or promote any illegal content or activity;
      3. not contain any defamatory, obscene, indecent, abusive, offensive, harassing, threatening, violent, hateful or inflammatory material;
      4. not bully, insult, intimidate or humiliate;
      5. not encourage, promote or provide instructions for deliberate self-harm;
      6. not encourage, promote or provide instructions for suicide;
      7. not encourage, promote or provide instructions for an eating disorder or behaviours associated with an eating disorder;
      8. not include child sexual abuse material;
      9. not include content that would be considered a criminal offence under laws relating to terrorism, child sexual abuse material, racism or xenophobia;
      10. not include material that might impair the physical, mental or moral development of persons under the age of 18;
      11. not incite or promote violence or discrimination which is based on race, sex, religion, nationality, disability, sexual orientation or age;
      12. not contain unsolicited content that sexually objectifies another person in a non-consensual way or contains fake or manipulated content concerning another person (including deepfakes);
      13. not infringe any patent, trade mark, trade secret, copyright or other intellectual property or other rights of anyone;
      14. not breach any person’s legal rights or contain any material that could give rise to any civil or criminal liability under applicable law or that otherwise might be in conflict with Fanbase terms and conditions or our Privacy and Cookies Policy;
      15. not breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
      16. not be in contempt of court;
      17. not be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
      18. give the impression that the Content emanates from Fanbase Global Limited if this is not the case;
      19. not be likely to harass, upset, embarrass, alarm or annoy any other person;
      20. not impersonate any person or misrepresent your identity or affiliation with any person;
      21. not be likely to deceive any person;
      22. not contain any advertising or promote any services or web links to other sites; 
      23. not request personal information from, or disclose personal information to, anyone, including financial information, payment information, email address, telephone number, or mailing address;
      24. be accurate (where it states facts);
      25. not advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse; and/or
      26. contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
   2. For the avoidance of doubt, for any Content in the form of video content:
      1. you must tell us immediately, if you upload a video containing any of the following: criminal material (relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia), videos and other material that might impair the physical, mental or moral development of persons under the age of 18 (restricted material);
      2. you must not upload a video containing harmful material;
      3. any advertising included in a video you upload must not:
         1. prejudice respect for human dignity;
         2. include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation;
         3. encourage behaviour prejudicial to health or safety;
         4. encourage behaviour grossly prejudicial to the protection of the environment;
         5. cause physical, mental or moral detriment to persons under the age of 18;
         6. directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity;
         7. directly encourage such persons to persuade their parents or others to purchase or rent goods or services;
         8. exploit the trust of such persons in parents, teachers or others; or
         9. unreasonably show such persons in dangerous situations.
            
            
   3. The Content Standards must be complied with in spirit as well as to the letter, and shall apply to each part of any Content as well as to its whole.
   4. We will determine, in our sole discretion, whether any Content breaches the Content Standards.
      
      
2. Prohibited uses
   1. You may not use our site:
      1. if you are under 18;
      2. in any way that breaches any applicable law;
      3. in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
      4. for the purpose of harming or attempting to harm minors in any way;
      5. to bully, insult, intimidate or humiliate any person;
      6. to send, knowingly receive, upload, download, use or re-use any material which does not comply with the Content Standards;
      7. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
      8. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;
      9. in any way that involves child sexual exploitation or abuse; or
      10. to upload terrorist content.
   2. You also agree:
      1. not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of Fanbase terms and conditions;
   3. not to access without authority, interfere with, damage or disrupt:
      1. any part of our site;
      2. any equipment or network on which our site is stored;
      3. any software which is used in the provision of our site; or
      4. any equipment or network or software which is owned or used by any third party.
         
         
3. Breach of this acceptable use policy
   1. When we consider that a breach of this acceptable use policy has occurred, we may take such action as we deem appropriate.
   2. Failure to comply with this acceptable use policy constitutes a material breach of Fanbase terms and conditions upon which you are permitted to use our site, and may result in us taking all or any of the following actions:
      1. immediate, temporary or permanent withdrawal of your right to use our site;
      2. immediate, temporary or permanent removal of any Contribution uploaded by you to our site;
      3. issue of a warning to you;
      4. legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
      5. further legal action against you; and/or
      6. disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
   3. We exclude our liability for all action we may take in response to breaches of this acceptable use policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.
4. General terms and conditions
   1. If you create a=Fanbase account on our site, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under your account. You must immediately notify us of any unauthorised use of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
   2. We have not reviewed, and cannot review, all of the material, including computer software, posted to our site, and cannot we do not represent or imply that we endorse the material posted on it, or that we believe such material to be accurate, useful or non-harmful. 
   3. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.
   4. Our site may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. 
   5. Our site may contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. 
   6. We disclaim any responsibility for any harm resulting from the use by visitors to our site, or from any downloading by those visitors of content posted on it.
   7. We have not reviewed, and cannot review, all of the material, including computer software, which is made available through the websites and webpages to which our site links, and that link to any subdomain of our site. We do not have any control over those websites and webpages, and we are not responsible for their contents or their use. By linking to a website or webpage which is outside of our site, we do not represent or imply that we endorse such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. We disclaim any responsibility for any harm resulting from your use of websites and webpages which are not related to our site.
   8. We reserve the right, at our sole discretion, to modify or replace any part of this policy. It is your responsibility to check this policy periodically for changes. Your continued use of or access to our site following the posting of any changes to this policy constitutes acceptance of those changes. We may also, in the future, offer new services and/or features through our site (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this policy.
   9. We may terminate your access to all or any part of our site at any time, with or without cause, with or without notice, effective immediately.
   10. All provisions of this policy which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
   11. You agree to indemnify and hold us harmless, our contractors, and our licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including legal fees, arising out of your use of our site, including but not limited to your violation of this policy.
   12. This policy is governed by the law of England and Wales, and is subject to the exclusive jurisdiction of the courts of England and Wales
